US Judge Mandates Release of Abrego Garcia from ICE Detention
A federal judge has ruled the prompt release of Kilmar Abrego Garcia from immigration custody, finding his continued confinement is without legal authority.
"Since Abrego Garcia's release after erroneous imprisonment in El Salvador, he has been taken back into custody, again without legal justification," the judge wrote in her order.
The situation stems from a erroneous removal to El Salvador earlier this year, which the government later acknowledged was an error. Following his return to the United States to face alien smuggling charges, he was held in federal custody.
In her order, the judge pointed out that the government does not have a current deportation order, which prevents them from deporting Mr. Abrego Garcia "at this juncture."
